In the case of Horton v. Cavalry Portfolio Services, LLC a settlement has been reached and claimants involved in the case can submit a claim online at the CPS TCPA Settlement website.  The case alleges Cavalry Portfolio Services in an attempt to collect debts used automatic telephone dialing systems to call class members without consent.

Calvary denies it made phone calls using any automatic dialing system without prior express consent liable under the Telephone Consumer Protection Act.

To get started with submitting a claim Claimants can follow these steps:

**Before submitting a claim click the appropriate green button based on when your account was open or closed.  

If your account was Open as of January 2, 2020 click the green File Open Account Form and be prepared to enter the following details:

  • Name 
  • Street
  • Email address
  • Cell phone number that was called
  • Select if you want debt relief or cash
  • Click the green Continue button

If your account was closed as of January 2, 2020 click the green File Closed Account Form be prepared to enter the following details at cpstcpasettlement.com:

Submit A Claim Form By Mail

If you would like to submit a claim form by mail you can download the proper forms by clicking the Important Documents tab at the top of the screen.  All of the important claim documents can be viewed and downloaded for print out including past court documents.

  • If you fail to submit a claim you will not receive a settlement payment
  • When you submit a claim you give up your right to sue the Defendant about the claims in this litigation
  • If you are a Class Member and exclude yourself from the settlement you won’t be included in the settlement
  • If you do nothing you will get no debt relief or payment and forgo your rights to sue the Defendant about the legal claims.

Settlement Details

Cavalry has agreed to establish a Debt Relief Fund of up to $18,000,000 and to establish a Cash Fund of $6,150,000.

Customers with an open account with Cavalry can claim a pro rata share of debt relief of up to $599 or claim a pro rata shared from the CAsh Fund

Can claim debt relief or cash but not both

Cash Fund also used to pay Class Counsel’s attorney’s fees and costs, pay incentive awards to the Class Representatives, pay costs and expenses of settlement administration – other remaining monies from uncashed checks may be redistributed to valid claimants.

What Determines a Class Member

If you were called by Cavalry on a cell phone attempting to collect the Aspect Ensemble Pro or the Avaya Proactive Contact 5.0 dialing systems between February 8,2009 and January 26, 2016.
